When we start working on a case, discovery and our own independent investigation of all evidence and witnesses is the most crucial phase. This provides the foundation for all negotiations, motions, and impeachment/rebuttal of the prosecution’s case, evidence and witnesses. We also meet and negotiate with law enforcement and prosecution, to carefully scrutinize the evidence and witnesses against our clients. We look at reports, photos and other accounts of evidence collection, looking for police misconduct and errors in collecting, analyzing and interpreting evidence. We painstakingly look for constitutional violations in searches (with and without warrants), the use of informants, confessions (mirandas given and coerced) and evidence planting, as these issues are the main issues that can result in dismissal of the charges, or at least being fully prepared for trial.
