Our firm has been very successful in handling Medical Marijuana cases.  Recently in a case involving multiple firearms as well as a Medical Marijuana collective we were able to resolve the matter and even get all the Marijuana plants and growing materials returned to our client.  We have had many transportation for sale cases that we were able to resolve under the medical marijuana statute which provides a complete defense to criminal charges if the criteria to establish a non-profit Medical Marijuana collective/cooperative could be established.  

The law is rapidly changing in the state of California and the Federal government appears to have backed down prosecuting Medical Marijuana cases since Obama took office.  The California Supreme Court ruled last week that the 8 ounce limit imposed by law enforcement as the legal amount to be possessed by certified Medical Marijuana patients is illegal and arbitrary.  On the other hand the Los Angeles City Council just passed sweeping legislation that will reduce the number of lawfully operating Medical Marijuana “Dispensaries” in Los Angeles County to 70.  Although approximately 80 other dispensaries that had registered since 2007 will be grandfathered in and can remain operative.  There is an estimation that approximately 500 Medical Marijuana Dispensaries will be affected by this legislation and that many will sue in order to remain open.

The problem with the California Medical Marijuana dispensaries is that many of the terms and requirements are vague and that the case law interpreting the statute is just now starting to develop.  The trend does appear to be however locally and on a national basis towards more liberalization of the availability and use of Medical Marijuana.
